Have you considered the risks of NOT being ADA compliant?
The ADA and the supporting documentation in this webinar will explain the necessity of why every building in the United States should provide access to individuals with disabilities, as well as being compliant with the ADA Laws. The compliance of equal access to buildings is a Federal Law and not just a suggestion.
The Americans with Disabilities Act (ADA) became law in 1990. It is a civil rights law in the U.S. Code that prohibits discrimination against individuals with disabilities in all areas of public life, including jobs, schools, and all public and/or restricted areas that are open to the public. There are five Titles in the U.S. code that pertain to ADA compliance. They govern the criteria required to achieve compliance with the ADA. Lack of compliance creates a risk for the building and its owners.
The current greatest risk is litigation based on violation of the civil rights of individuals with disabilities. There are DOJ fines and penalties that are accessed for violations of ADA non-compliance, ranging from $75,000 for the first offense to $150,000 for the second and all subsequent offenses. There were over 11,472 ADA lawsuits in the United States in 2023, quadrupled (4X) since 2013 per the law firm Seyfarth Shaw’s most recent 2023 report. These numbers are expected to rise in the future as awareness of the Civil Rights Laws pertaining to the violation of the rights of individuals with disabilities being able to access buildings becomes more prevalent.
